Terms & Conditions - Summary

  • Start the booking process by completing the booking form.
  • Bookings are secured upon receipt of a deposit.
  • Rental cost includes: Villa rental, airport transfers, utilities, twice-weekly maid service, use of linen & towels, and a callout service for repairs or equipment problems.
  • Rental cost does not include: transport costs (other than airport transfers), food, consumable items, insurance, breakages or excessive cleaning charges.
  • Nominally, check-in is after 3pm, check-out is before 11am.

Banyan Villas Full Terms and Conditions


  • Banyan Villas is the trading name of Banyan Villas (Thailand) Company Limited, hereforth referred to as "The Company" whose registered office is Coconut Paradise, 8/35, Banyan Villas, Moo 5 Maenam, Koh Samui, Suratthani 84330, Thailand.
  • The Company is an owner of property available to let on a short or long term basis in Koh Samui, Thailand.
  • Accuracy of Web and other Information. The Company makes every effort to ensure that advertised descriptions and images are correct, however The Company reserves the right to make changes/improve the properties and services from time to time.


  1. Initial Deposit - An initial deposit of 30% must be paid to confirm a booking.
    Payment can be made by:
    Either direct bank transfer to:

    Branch: Ramkamhaeng, Bangkok

    Or By: Or By: Visa or Mastercard through the Banyan Villas web site.
  2. No contract will exist between you and The Company until The Company has received and accepted the deposit payment and the completed booking form.
  3. Your reservation will be confirmed upon payment of a deposit.
  4. If payment has not been received within 7 banking days, The Company will assume that you have cancelled the reservation.
  5. Balance Payment - Payment of the outstanding balance is due 8 weeks before the arrival date and The Company will send out a reminder close to the due date. If the booking is made within 8 weeks of the arrival date, 100% of the cost of the property rental shall be due at the time of booking. Payment can be made by direct bank transfer or by credit card as above (2a)
  6. Included in the Rental Rate:
    • Airport transfers (one transfer to the villa and one transfer to the airport)
    • Utilities (Electricity and water)
    • Twice weekly maid service
    • All Linen and towels – changed once per week
    • Call out service to repair any equipment problems
  7. Excluded in the Rental Rate:
    • Car rentals and other transport charges
    • Food drinks and other consumables
    • Cancellation Insurance
    • Insurance for personal possessions
    • Excessive cleaning charges (e.g. upholstery)
    • Breakages
  8. Long Term Rentals (over 6 months) – different terms apply, please request information from The Company.
  9. Car rentals initial stocking of food, plus additional maid services can be ordered in advance at an additional cost. These services can be ordered at the time of booking.
  10. Any additional charges for breakages or for other services purchased from The Company in Samui should be settled locally on check out. The Renter agrees to pay the owner for the cost of repairing or replacing (solely at the owner’s discretion) any item of property, or contents at the Villa, which is damaged due to negligence or wilful default of the renter during the renter’s occupation, or which is missing. The person in whose name the booking is made acts on behalf of all other persons named, and becomes responsible to The Company for all payments in respect of the booking.


  • In the event that you have to cancel your booking at any time it should be noted that no refund will be made whatsoever.
  • It is a condition of the booking that the entire party is covered by comprehensive travel insurance, which will need to provide separately to your booking, such insurance should provide compensation to you in the event of cancellation (see Insurance).


Although it is unlikely that The Company will have to make any changes to confirmed arrangements, it is sometimes unavoidable in which case we will advise you at the earliest possible date. If, for any reason beyond our control, we are unable to provide you with the property booked, The Company shall reserve the right to cancel the reservation. For example, if the properties are damaged or rendered unusable Banyan Villas will try to locate an alternative property for the period required. However, if this is not possible, or you do not wish to be transferred, The Company will cancel the booking and refund you in full, less any bank transfer charges. Banyan Villas shall not be liable for any further obligations or claims by the client.


The Company will endeavour to accommodate changes in Booking dates wherever this is possible. This will be effected at no extra charge should alternative dates be available.


  • Guest should assume that Check-in time is after 3 p.m., and checkout time is prior to 11 a.m.
  • The Company will endeavour to accommodate early check-ins and late check outs if requested at the time of booking, however this cannot always be guaranteed.


  1. Only those persons entered on the booking form may reside at the villa as guests. Please notify us as soon as possible of any changes.
  2. The number of people staying at the villa must not exceed the maximum capacity indicated by you on the The Company booking form, except in the case of infants (under two years old), or unless specifically authorised.
  3. Should the owner or the local representative find that the number of people staying at the property exceeds that on the booking form, he may, at the absolute discretion of The Company, ask the extra person or persons to vacate the property forthwith.
  4. No camping is permitted in the grounds or gardens adjacent to the villas.


  1. It is a condition of the booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).
  2. The Company is not responsible to you and your party for any and all claims including any accidents related to the use of the property facilities or locally procured third party services such as watercraft, water sports, jeep or motorbike rental etc…
  3. The Company will not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside Banyan Villas’ control such as civil disturbances, fires, floods, severe weather, acts of God, acts of Government etc.


  1. In the unlikely event of a problem with your rental property occurring, whilst you are in Koh Samui, please contact us directly so that the matter can be attended to. The Company owners are available on site.
  2. The Company does not accept responsibility for the breakdown of the supply of water, or electricity, nor of swimming pool filtration systems, although we will use our best endeavours to arrange for any such problems to be solved quickly. Banyan Villas and their maintenance team will use their best endeavours to rectify such issues.
  3. It is understood that infrastructure, local standards and conditions are often of a less developed nature than those guests may be accustomed to in their home countries. The Company will do as much as can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for problems occurring due to the failure of local infrastructure.
  4. Should a problem remain unresolved please make a complaint in writing to The Company within 14 days of the completion of the rental period.
  5. If the Villa is vacated before the end of the rental period without prior agreement of The Company this may result in the loss of all rights to compensation.


The person signing the contract is responsible for the correct and appropriate behaviour of the guests staying at the property. Should any member of the party not behave in such a manner The Company may at their absolute discretion ask the offending guest or guests to vacate the property forthwith.


  1. Any valuables left at the property are left at one’s own risk. Neither The Company nor the owners or staff at the property is responsible for any loss or damage to valuables or other property.
  2. The Company are equipped with a safe for the safe keeping of valuables.


Any contract that is made will be with the acceptance by both parties of these terms and conditions, which are governed by Thai law, and both parties will submit to the exclusive jurisdiction of the Thai courts.


  1. These Terms & Conditions govern all bookings with Banyan Villas (Thailand) Co. Ltd. Any booking made or order placed by you, whether through the Company's website or otherwise, shall be deemed an offer by you to rent the relevant accommodation subject to these terms & conditions.
  2. All bookings through Banyan Villas (Thailand) Co. Ltd. or their Agents and all matters arising from them are subject to Thai law and to the exclusive jurisdiction of the courts of Thailand.
  3. The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. Booking services with the company are only available to persons who are at least 18 years old. By submitting a booking you warrant and confirm to us that you have read these Terms & Conditions and agree to comply with them.
